This notice explains how the Science and Co, Inc. ("Science & Co", "we", "us" and "our") text messaging program works, when we will and will not message you, how to stop messages, and how we handle mobile information. It supplements our Privacy Policy and our Terms & Conditions, which continue to apply.
Transactional and care related messages concern your order, your prescription, your consultation, your shipment or your account. They are necessary in order to deliver the services you have asked for.
Marketing messages promote products, offers or content. We send two kinds, and both count as marketing.
Promotional messages tell you about products, pricing, offers and content.
Evaluation follow up messages are sent if you gave us your mobile number partway through an evaluation and did not finish it. We may text you afterwards to help you complete it. These are marketing messages and not transactional ones, which means every protection described in this notice applies to them in the same way, including your right to stop them.
You can stop either kind at any time by replying STOP.
Consent to receive marketing messages is not a condition of purchasing any product or service. You can buy from us without ever agreeing to marketing messages.
You join the program by providing your mobile number and agreeing to receive messages, for example at checkout, during intake, or through a form on our Website. This includes a number you enter partway through an evaluation that you do not go on to complete. Message frequency varies according to your activity and the treatments you use.
To stop marketing messages, reply STOP to any message from us. You will receive one final message confirming that you have been unsubscribed, after which we will stop sending marketing messages to that number. Stopping marketing messages does not stop transactional and care related messages that are necessary in order to deliver your treatment, such as shipping notifications or messages from your care team. If you wish to stop those as well, contact us and we will explain what that means for your care and how to manage it.
We send marketing messages during reasonable hours, and we follow the laws that apply to the times at which marketing messages may be sent where you live.
Transactional and care related messages that you have requested, or that are necessary in order to deliver your treatment safely, may be sent at other times where permitted by law. A shipping confirmation or a message from your care team is not a marketing message.
No mobile information will be shared with third parties or affiliates for marketing or promotional purposes. Information obtained through our text messaging program, including your mobile number and your consent status, will not be sold, rented or shared with any third party for that party's own marketing purposes.
We do share mobile information with service providers who help us operate the messaging program, such as our messaging platform and our telehealth and pharmacy partners, strictly so that they can deliver the services on our behalf. Those providers are not permitted to use your information for their own marketing.
Message and data rates may apply, depending on your mobile plan. Message frequency varies. Mobile carriers are not liable for delayed or undelivered messages. Delivery is subject to your carrier's service availability, and we cannot guarantee that every message will arrive.
Please keep your contact details current. If you change or give up your mobile number, tell us promptly so that we do not send messages intended for you to someone else. You confirm that you are the account holder or the customary user of the number you give us, and that you are authorized to consent to receive messages at it.
Text messaging is not a fully secure channel. We keep the health detail in messages to the minimum necessary, and we will not include sensitive clinical information in a message where it can reasonably be avoided. Do not use text messages for medical emergencies. If you are experiencing a medical emergency, call 911 or go to your nearest emergency room.
Any dispute, claim or controversy relating to our text messaging program, including any claim under the Telephone Consumer Protection Act or under any state telemarketing, calling time or messaging law, is subject to the Arbitration Agreement and Class Action Waiver in Section 14 of our Terms & Conditions.
By providing your mobile number to us, you agree that any such dispute will be resolved by binding, individual arbitration, and that you are waiving your right to have that dispute decided by a court or a jury, and your right to participate in a class, collective or representative action, whether as a representative, a member or an opponent.
You may opt out of the Arbitration Agreement on the terms set out in Section 14 of our Terms & Conditions, within thirty days of the date you first provide your mobile number or otherwise use the Website. Opting out of arbitration does not stop your messages. To stop messages, reply STOP to any message from us.
