These Terms of Service (the "Terms") govern your access to and use of the websites, mobile interfaces and other online properties operated by Science & Company ("Science & Co"), including https://science.co and any successor domains (the "Website"), together with all related products, services, content and transactions made available through the Website.
The assessment provided on the Website does not create a clinician and patient relationship between you and Science & Co. Science & Co is not a medical services provider. We operate a telehealth technology platform that connects users with independent, licensed clinicians and with the telehealth platforms those clinicians operate or are affiliated with (respectively, the "Clinicians" and the "Platform"). Those Clinicians follow established medical protocols and determine eligibility for treatment on the basis of individual assessments. Every prescribing decision is made solely at the discretion of the Clinician.
Science & Co and the Clinicians are separate legal entities performing distinct roles. Science & Co provides non-clinical content, marketing, customer support and other informational and administrative services through the Website. The Clinicians operate the Platform and provide platform related services. Independent licensed healthcare professionals provide healthcare services through the Platform. For the purposes of these Terms, the content and non-clinical services provided by Science & Co, the Platform and platform related services operated by the Clinicians, the healthcare services provided by independent licensed healthcare professionals, and any products you are able to purchase through the Website and the Platform are referred to collectively as the "Services".
Unless expressly stated otherwise, references to "we", "us" or "our" in these Terms refer collectively to Science & Co and the Clinicians and, solely in respect of the provision of the Services, the independent healthcare providers and pharmacies involved in providing them. By accessing or using the Website or any of the Services, you agree to be bound by these Terms.
Please read these Terms carefully before accessing or using the Website or the Services.
THESE TERMS CONTAIN A BINDING ARBITRATION AGREEMENT AND A CLASS ACTION WAIVER THAT REQUIRE YOU TO ARBITRATE ALL DISPUTES WITH US ON AN INDIVIDUAL BASIS. PLEASE SEE SECTION 14 FOR MORE INFORMATION. YOU EXPRESSLY AGREE THAT DISPUTES BETWEEN YOU, SCIENCE & CO, THE CLINICIANS, THE PROFESSIONAL ENTITIES AND THE PHARMACIES WILL BE RESOLVED BY BINDING, INDIVIDUAL ARBITRATION, AND YOU WAIVE YOUR RIGHT TO PARTICIPATE IN A CLASS ACTION LAWSUIT OR CLASS WIDE ARBITRATION.
Acceptance of Terms. By accessing or using the Website or any of the Services, or by clicking any button or checkbox indicating your acceptance of these Terms where that option is presented, you agree to be bound by these Terms as a legally binding agreement. If you do not agree to these Terms, you may not access or use the Website or any Services.
Amendment of Terms. We may amend these Terms from time to time. Unless we expressly provide a delayed effective date, amendments become effective immediately upon posting of the updated Terms on the Website. Your continued access to or use of the Website or any Services after amended Terms are posted constitutes your acceptance of them. We may also modify, suspend or discontinue any part of the Services at any time. To the maximum extent permitted by applicable law, we are not liable for any modification, suspension or discontinuation of the Services.
Additional Terms. Certain Services may be subject to additional terms, conditions, guidelines or rules ("Additional Terms") posted on the Website or otherwise made available to you. Any Additional Terms are incorporated into these Terms by reference. Where these Terms and any applicable Additional Terms conflict, the Additional Terms will control solely in respect of the applicable Service.
Privacy. Your access to and use of the Website and the Services are subject to our Privacy Policy, which describes how we collect, use and disclose information about you. Please review our Privacy Policy at https://science.co/privacy-policy.
Availability. The Services are offered only to individuals located within the United States and are available in all fifty states and the District of Columbia. Science & Co and the Clinicians operate from the United States and the Services are not intended for use outside the United States.
Eligibility. You must be at least eighteen years of age to access or use the Website or any Services. By accessing, using or submitting information through the Website or the Services, you represent and warrant that you are at least eighteen years old.
Science & Co, on its own behalf and on behalf of one or more professional corporations incorporated, formed or authorised in one or more states and for which Science & Co provides non-clinical content, marketing, customer support and other informational and administrative services (collectively, the "Professional Entities"), makes certain information available regarding treatment programmes and facilitates your access to telemedicine and expert medical services provided by the Professional Entities. The Services may also facilitate your access to prescription fulfilment and medication dispensing services offered by one or more independently owned and operated, duly licensed pharmacies (collectively, the "Pharmacies").
Science & Co does not provide medical advice, diagnosis or treatment and does not dispense medications. All healthcare services are provided exclusively by the Professional Entities and their licensed healthcare professionals, and all prescription fulfilment and dispensing services are provided exclusively by the Pharmacies in accordance with applicable law.
Science & Co is not a medical group, a pharmacy or a healthcare provider, and is not a "covered entity" as that term is defined under the Health Insurance Portability and Accountability Act of 1996, Public Law 104-191, and its implementing regulations (collectively, "HIPAA"). The role of Science & Co is limited to providing non-clinical information and administrative services and facilitating access to the Services offered by the Professional Entities and the Pharmacies. Science & Co is independent from the Professional Entities, the Pharmacies and the licensed healthcare professionals who may provide services through them. Science & Co is not responsible for the acts or omissions of the Professional Entities, the Pharmacies or those healthcare professionals, nor for the content of their communications with you. Science & Co does not engage in the practice of medicine or pharmacy and does not provide healthcare or pharmacy services of any kind.
Science & Co does not offer medical advice, diagnosis or treatment. All information made available through the Website, or in connection with communications supported by Science & Co or the Clinicians, is provided for general informational purposes only. It is not intended to create a physician and patient or provider and patient relationship, nor to replace or supplement any existing relationship you may have with a licensed healthcare provider as defined by applicable state or federal law. Use of the Website and reliance on any information provided by Science & Co is at your own risk and is not a substitute for professional medical diagnosis or treatment.
Neither Science & Co, the Clinicians, the Professional Entities nor the Pharmacies participate as a provider in any federal, state or private payor healthcare programme, including Medicare or Medicaid, in respect of services or products made available through the Services.
Accordingly, neither you nor Science & Co, the Clinicians, the Professional Entities or the Pharmacies may seek or receive reimbursement from any federal, state or private payor healthcare programme for any services or products provided to you through the Services.
To the extent that any laboratories, pharmacies or licensed healthcare professionals accessible through the Services independently participate in federal, state or private payor healthcare programmes outside of the Services, you acknowledge and agree that the manner in which services and products are made available through the Services falls outside those programmes and is not intended to constitute a covered benefit. By choosing to use the Services you are expressly electing to obtain products and services on a cash pay basis, outside any federal, state or private payor healthcare programme.
By using the Services you acknowledge and agree that you are voluntarily choosing to obtain products and services on a cash pay basis and are solely financially responsible for all services and products provided to you by or through the Services, and that neither you nor Science & Co, the Clinicians, the Professional Entities, licensed healthcare professionals, laboratories or the Pharmacies will submit any claim for reimbursement to any federal, state or private payor healthcare programme for services or products provided to you through the Services.
Telehealth allows healthcare providers to assess and treat patients remotely using technology. Healthcare services delivered via telehealth may offer potential benefits, and there are also potential risks. To use the Services you must consent to treatment via telehealth. Please see the Telehealth Consent at https://science.co/telehealth-consent. The Telehealth Consent is incorporated into these Terms by reference and forms part of these Terms.
Our Content. The Website and the non-clinical components of the Services are owned and operated by Science & Co and its licensors. All content, recordings, visual interfaces, graphics, design, compilation, information, data, computer code, software, text, images, video, audio, trademarks, service marks, trade names and other materials or elements made available through the Website (collectively, the "Content") are protected by United States and international copyright, trademark, trade dress, patent and other intellectual property and proprietary laws.
Except as expressly stated otherwise, all Content available through the Website is owned by Science & Co or its third party licensors. All trademarks, service marks and trade names displayed on the Website are proprietary to Science & Co or its licensors, whether registered or unregistered, and may not be used in any manner likely to cause confusion regarding endorsement, affiliation or sponsorship.
Subject to your compliance with these Terms, Science & Co grants you a limited, non-exclusive, non-transferable, revocable licence to access and use the Content solely for your personal, non-commercial use. Except as expressly permitted by Science & Co in writing, you may not copy, reproduce, distribute, transmit, publicly display or perform, publish, license, sell, modify, adapt, create derivative works from or otherwise exploit any Content. Downloading or copying Content does not transfer any ownership rights to you. All rights not expressly granted are reserved by Science & Co and its licensors.
Illustrative and computer generated imagery. Certain images, product renderings, lifestyle photography and before and after visuals presented on the Website are illustrative and may be created or enhanced using computer generated or artificial intelligence assisted techniques. Such imagery is provided for general illustrative purposes only. It does not depict actual patients unless expressly stated, does not represent a guarantee, promise or prediction of any particular outcome, and should not be relied upon as evidence of the results any individual may achieve. Individual results vary.
Electronic Communications. By accessing or using the Website or the Services you expressly consent to receive electronic communications from Science & Co, including communications provided through the Website, by email, by text message or by telephone using the contact information you provide. Those communications may include agreements, notices, disclosures, authorisations, verifications, confirmations and other information relating to your use of the Services. You agree that any electronic communications we provide to you satisfy any legal requirement that such communications be in writing.
Categories of message. We send two categories of message. Transactional and care related messages concern your order, your prescription, your consultation or your account, and are necessary in order to deliver the Services. Marketing messages promote products, offers or content. Consent to receive marketing messages is not a condition of purchasing any product or service.
Messaging times and frequency. We do not place marketing calls or send marketing text messages outside the hours of 8:00 am to 9:00 pm in the recipient's local time zone. Where the law of your state imposes a narrower daily window, a later permitted start time, an earlier evening cut off, a restriction on contact on Sundays, a restriction on contact during legal holidays, or a limit on the number of messages that may be sent within a rolling twenty four hour period, we observe the stricter requirement applicable to your state.
Without limiting the generality of the foregoing, and by way of illustration rather than as an exhaustive list, we observe an 8:00 pm evening cut off for recipients in Alabama, Connecticut, Florida, Louisiana, Nevada and Oklahoma; a 9:00 am earliest start for recipients in Connecticut, Illinois, Michigan, Minnesota, Nevada, New Mexico, Pennsylvania, Rhode Island, South Dakota and Texas; a 10:00 am earliest start for recipients in Kentucky; a further narrowed daily window for recipients in Rhode Island; restricted contact on Sundays and on applicable legal holidays for recipients in Alabama, Louisiana, Mississippi, Rhode Island, South Dakota and Utah; a restricted Sunday start time for recipients in Pennsylvania and Texas; and a limit of three marketing messages concerning the same subject matter within any twenty four hour period for recipients in Florida and Oklahoma.
Transactional and care related messages that you have requested, or that are necessary in order to deliver the Services to you, may be sent outside the windows described above where permitted by applicable law.
Opting out. You may withdraw your consent to marketing text messages at any time by replying STOP to any message you receive from us, and you may request assistance by replying HELP. Withdrawing consent to marketing messages does not withdraw your consent to transactional or care related messages that are necessary in order to deliver the Services, which you may manage through your account or by contacting support@science.co. Message and data rates may apply. Message frequency varies. Mobile carriers are not liable for delayed or undelivered messages.
Prescription Products. Certain products available through the Services and accessed via the Platform require a valid prescription issued by a licensed healthcare provider. You will not receive a prescription product unless you have completed a consultation through the Platform, the provider has determined that the product is appropriate for you, and the provider has issued a prescription.
If a provider issues a prescription, you may choose to have it fulfilled through one of the Pharmacies accessible through the Services, or you may elect to have the prescription sent to a pharmacy of your choice.
Please note that products fulfilled by the Pharmacies may not be dispensed in child resistant packaging and may not be provided in child resistant containers.
Subscriptions. Certain products available through the Services are offered on a subscription basis. If you purchase a subscription product, your selected payment method will be charged automatically at the recurring intervals disclosed for that product during checkout, unless and until you cancel. You may cancel a subscription at any time up to 72 hours before the applicable processing date by emailing support@science.co or by logging into your account.
For convenience you will be presented with a single total subscription price. Where a subscription product requires a consultation with a licensed healthcare provider or includes a prescription product fulfilled by one of the Pharmacies, the total price you pay includes amounts charged by the applicable Pharmacy for the prescription drug, amounts charged by the applicable Professional Entity for the services provided by the provider, and applicable fees charged for access to and use of the Platform. By submitting your payment information you authorise Science & Co, our affiliate Clinicians or our third party payment processor to charge the amount due in accordance with their terms. Payment information is processed and stored securely by our third party payment processor and is not stored by Science & Co. Science & Co collects these amounts on behalf of the Pharmacies and Professional Entities, as applicable, and remits the corresponding portions to them.
Security. You are responsible for your access to and use of the Services, including all financial transactions. You agree to notify Science & Co immediately of any breach of security that may occur through your access to or use of the Services and to prevent any further occurrence. If you become aware that someone may be impersonating you, or attempting to impersonate you, in using the Services or in processing any financial transaction through the Services, you should contact us immediately.
Accuracy of Personal Information. You represent and warrant that all information you provide to Science & Co or the Clinicians through the Website is current, accurate, complete and truthful, including all initial and updated registration information such as legal name, street address, email address, telephone number and financial transaction account information. You further represent and warrant that you are an authorised account holder of any financial transaction account you provide to Science & Co or the Clinicians through the Website.
Without limiting the prohibitions and restrictions found elsewhere in these Terms, you agree not to:

The Website may include links to, or access to, third party websites, platforms or services (collectively, "Linked Sites") solely for your convenience. Science & Co does not control, endorse, sponsor or assume any responsibility for any Linked Sites, or for any information, content, materials, products or services made available through them. Science & Co makes no representations or warranties, express or implied, regarding the accuracy, completeness or reliability of any information, content, materials, products or services available on or through any Linked Sites.
Your access to and use of Linked Sites is entirely at your own risk and is subject to the terms and policies of the applicable third party. We encourage you to review the terms of use and privacy policies governing your use of any Linked Sites before interacting with them.
Science & Co retains personal information only for as long as is reasonably necessary to provide and maintain the Services, to comply with applicable legal, regulatory, accounting or reporting obligations, to resolve disputes and enforce our agreements, or to pursue our legitimate business purposes consistent with applicable law. Science & Co may delete or anonymise personal information when it is no longer needed for these purposes, unless a longer retention period is required or permitted by law or by an applicable agreement.

You agree to defend, indemnify and hold harmless Science & Co and the Clinicians, their affiliates, and their respective officers, directors, employees, agents, licensors and contractors, as well as any third parties that offer products or services in connection with the Services, including the Professional Entities, licensed healthcare providers and the Pharmacies (collectively, the "Indemnified Parties"), from and against any and all claims, demands, actions, suits, proceedings, damages, judgments, settlements, losses, liabilities, costs and expenses, including reasonable attorneys' fees and litigation expenses, arising out of or relating to your use of the Services, your fraud, wilful misconduct or violation of applicable law, your breach of these Terms, or your infringement or violation of the rights of any other person or entity.
The Indemnified Parties reserve the right, at their own expense, to assume exclusive control of the defence and settlement of any claim subject to indemnification under this section, and you agree to cooperate reasonably with the defence of any such claim. You may not settle any claim subject to indemnification without the prior written consent of the applicable Indemnified Party if that settlement imposes any obligation, admission or liability on that Indemnified Party.
Science & Co is not a provider of medical treatment, and the Services are not intended to be a substitute for professional medical or nursing advice, diagnosis or treatment. By accepting these Terms you acknowledge and agree that the Services do not constitute, and should not be interpreted as, medical advice, diagnoses, opinions or treatment recommendations, and that the Services are not intended to replace or serve as a substitute for advice, diagnosis or treatment provided by a licensed physician or other qualified healthcare professional. You should always seek the advice of your physician or another qualified healthcare provider with any questions regarding a medical condition or health concern.
The Services are provided on an "as is", "where is" and "as available" basis. To the maximum extent permitted by applicable law, Science & Co disclaims all warranties of any kind, whether express, implied or statutory, including without limitation any implied warranties of merchantability, fitness for a particular purpose, non-infringement, title, accuracy, completeness, availability, reliability or freedom from viruses or other harmful components.
Science & Co does not warrant that the Services will be uninterrupted, secure, timely, error free or free from technical failures, nor does Science & Co make any warranty regarding the accuracy, adequacy or completeness of any information, materials or content made available through the Services. Science & Co is not responsible for any problems, delays, interruptions or technical malfunctions of networks, systems, servers, software, internet service providers, telecommunications systems or computer equipment, or for any injury or damage to users or third parties resulting from the use of, or inability to use, the Services.
Some jurisdictions do not allow the exclusion of certain warranties or limitations on implied warranties. To the extent those laws apply to you, some or all of the above disclaimers may not apply and you may have additional rights under applicable law.
To the fullest extent permitted by applicable law, in no event shall Science & Co, the Clinicians, their affiliates, or any third party offering products or services through the Services, including the Professional Entities, licensed healthcare providers or the Pharmacies (collectively, the "Covered Parties"), be liable to you or any other person or entity for any indirect, incidental, special, consequential, exemplary or punitive damages, including without limitation damages for personal or bodily injury, emotional distress, wrongful death, loss of data, loss of profits or business interruption, arising out of or relating to your access to or use of, or inability to access or use, the Website or the Services, including any information or content made available through the Services.
This limitation applies regardless of the legal theory asserted, whether based in contract, tort including negligence, warranty, statute or otherwise, and regardless of whether any Covered Party has been advised of the possibility of such damages.
To the fullest extent permitted by applicable law, the aggregate liability of the Covered Parties for any claims arising out of or relating to these Terms or your use of the Website or the Services shall not exceed the greater of the total amount paid by you to Science & Co or the Clinicians for the Services in the twelve months preceding the event giving rise to the claim, or one hundred United States dollars.
PLEASE READ THIS PROVISION CAREFULLY. It requires you to arbitrate disputes on an individual basis and limits the manner in which you may seek relief.
You agree that any dispute, claim or controversy arising out of or relating to this Arbitration Agreement, these Terms, the Privacy Policy, the Website, the Services, or the advertising or marketing practices, products or services of Science & Co, the Clinicians, the Professional Entities and the Pharmacies (collectively, the "Disputes") shall be resolved by binding, final and confidential arbitration on an individual basis before a single arbitrator administered by the American Arbitration Association ("AAA") in accordance with its Consumer Arbitration Rules then in effect.
This Arbitration Agreement is governed by the Federal Arbitration Act ("FAA"), 9 U.S.C. sections 1 to 16, and shall be interpreted broadly consistent with the FAA. The arbitrator shall have exclusive and sole authority to resolve any dispute regarding the interpretation, applicability, enforceability or formation of this Arbitration Agreement, including any claim that all or any part of it is void or voidable.
The arbitrator shall apply the substantive law of the State of California, to the extent consistent with the FAA. The arbitrator may award any relief available in an individual action under applicable law, including compensatory and statutory damages and attorneys' fees and costs where authorised by statute. The arbitrator may award injunctive or declaratory relief only to the extent necessary to resolve your individual claim, and may not award relief that would affect other users or the public at large.
The arbitrator may resolve only individual Disputes between you and Science & Co, the Clinicians, the Professional Entities and the Pharmacies, and may not consolidate claims or proceedings, or hear class, collective, representative or private attorney general claims or requests for relief on behalf of other individuals.
If a court or arbitrator determines that any portion of this Arbitration Agreement is unenforceable as to a particular claim or remedy, then that claim or remedy, and only that claim or remedy, shall be severed and may be brought in court, and all remaining claims shall be arbitrated.
Notwithstanding the foregoing, Science & Co and the Clinicians may seek injunctive or equitable relief in state or federal court to protect their intellectual property rights, including claims arising from actual or threatened misappropriation, infringement or unauthorised use of intellectual property. You agree that venue is proper and that you are subject to personal jurisdiction in those courts.
Unless you opt out in time, you understand and agree that you are waiving the right to have a court or jury decide your Dispute, to obtain discovery to the same extent as in court, to participate in a class, collective or representative action whether as a representative, member or opponent, to act as a private attorney general, or to join or consolidate your Dispute with that of any other person. Other rights that would be available in court may also be unavailable in arbitration.
Opt-Out Right. You may opt out of this Arbitration Agreement within thirty days of the date you first purchase or register for a product or service through the Website, or otherwise use or access the Website, by sending written notice to:

In notifying us of alleged copyright infringement, the Digital Millennium Copyright Act requires that you include a description of the copyrighted work that is the subject of the claimed infringement, a description of the infringing material and information sufficient to permit us to locate it, contact information for you including your address and telephone number or email address, a statement by you that you have a good faith belief that the material in the manner complained of is not authorised by the copyright owner or its agent or by the operation of any law, a statement by you signed under penalty of perjury that the information in the notification is accurate and that you have the authority to enforce the copyrights claimed to be infringed, and a physical or electronic signature of the copyright owner or a person authorised to act on the copyright owner's behalf. Failure to include all of the above information may delay the processing of your complaint.
Waiver and Severability. To the extent that an arbitrator or court of competent jurisdiction determines any part of these Terms to be invalid or unenforceable, that part will be modified by the arbitrator or court solely to the extent necessary to make it enforceable, and the remainder of these Terms will remain in full force and effect. Our failure to exercise or enforce a legal right, remedy or benefit contained in these Terms or in any applicable law does not constitute a waiver of our right to do so later.
Choice of Law and Forum. These Terms shall be governed in all respects by the laws of the State of California, without regard to conflict of law provisions, and consistent with the Federal Arbitration Act to the extent permitted by applicable law. If for any reason a claim proceeds in court rather than in arbitration, including any claim brought by a party outside the United States, the dispute shall be brought exclusively in the state or federal courts located in Los Angeles County, California, and you and we forever waive the right to contest jurisdiction or venue in those courts.
Assignment. We may assign our rights and obligations under these Terms. These Terms will inure to the benefit of our successors, assigns and licensees. You may not assign, transfer or sell, whether voluntarily or by operation of law, your rights or obligations under these Terms, nor delegate your duties, to any other person without our prior written consent. Any purported assignment without our consent will be void and will constitute a breach of these Terms.
Entire Agreement. These Terms, together with any additional terms, policies or agreements expressly incorporated by reference or posted by Science & Co in connection with the Website or the Services, constitute the entire agreement between you and Science & Co regarding your access to and use of the Website and the Services, and supersede all prior or contemporaneous agreements, communications or understandings, whether written or oral, relating to the subject matter of these Terms, including any prior versions of these Terms.

Results and treatment experiences shared on this website are based on self-reported information from users under clinician supervision. Individual outcomes vary depending on adherence to the prescribed plan and the guidance of the clinician. Science & Co does not manufacture or dispense any medications.
Compounded drug products are not approved or evaluated for safety, effectiveness or quality by the FDA. Prescription required. Science & Co offers GLP-1 medications exclusively from United States pharmacies. If deemed medically appropriate by one of our partner clinicians, a compounded medication may be prescribed. Compounded medications are highly regulated, and compounding pharmacies are licensed and inspected by Boards of Pharmacy, but the FDA has not evaluated these medications for safety, quality or efficacy.
